“Janganlah menikahkan janda sebelum meminta pendapatnya dan janganlah menikahkan perawan sebelum meminta persetujuannya.” Sahabat bertanya, “Ya Rasulullah, apa tanda persetujuannya?” Beliau menjawab, “Ia diam, bila malu berbicara.” Dalam riwayat Muslim disebutkan, “Seorang janda lebih berhak atas dirinya daripada walinya,” (HR. Bukhari dan Muslim).
Hadis ini menjelaskan hak perempuan untuk memperoleh kebebasan dalam memilih calon suami.
Oleh karena itu, anak gadis boleh dinikahkan hanya bila telah dimintai persetujuannya, dan janda hanya boleh dinikahkan bila telah dimintai pendapatnya.
